Terms & Conditions

These Terms & Conditions govern your use of legacypavingllc.com and any engagement with Legacy Paving & Construction, LLC ("Legacy Paving," "we," "us," or "our") for services. By using our website or engaging our services, you agree to these terms in full. If you do not agree, do not use our website or engage our services.

1. Services

Legacy Paving & Construction, LLC provides asphalt paving, concrete flatwork, sealcoating, cracksealing, striping, excavation, and related construction services in Oregon and Washington. All services are subject to a written estimate and signed agreement prior to commencement of work. No verbal agreement, email exchange, or website inquiry constitutes a binding contract for services.

2. Estimates & Pricing

All estimates provided — whether verbal, written, or through our website — are based on conditions known at the time of estimate. Final pricing may vary due to unforeseen site conditions, material cost fluctuations, scope changes requested by the customer, or conditions not visible or disclosed at the time of estimate.

Estimates are valid for 30 days from the date issued unless otherwise stated in writing. Legacy Paving reserves the right to revise any estimate if site conditions differ materially from what was represented at the time of proposal.

3. Contract & Payment Terms

A signed contract or accepted estimate is required before any work begins. Work will not be scheduled or commenced until a signed agreement is on file and any required deposit has been received.

Payment terms are outlined in each individual contract. Failure to pay on time may result in work stoppage, removal from the schedule, and additional fees. Accounts past due are subject to interest charges and collection action. In the event of non-payment, Legacy Paving & Construction, LLC reserves the right to pursue all available legal remedies including but not limited to filing a lien on the property in accordance with Oregon Revised Statutes (ORS Chapter 87) and Washington State lien laws (RCW Chapter 60.04).

4. Changes & Scope Creep

Any changes to the agreed scope of work must be requested and approved in writing before additional work is performed. Verbal change orders are not binding on Legacy Paving & Construction, LLC. Additional work performed outside the original scope will be billed accordingly and is subject to the same payment terms as the original contract.

5. Customer Responsibilities

The customer is responsible for:

Providing accurate site information and access at the time of estimate and during the project
Disclosing any known underground utilities, irrigation systems, drainage lines, or other subsurface conditions
Ensuring the work area is clear and accessible on the scheduled date
Obtaining any required permits unless otherwise agreed to in writing
Notifying Legacy Paving of any HOA, municipal, or property restrictions that may affect the work

Legacy Paving & Construction, LLC is not liable for damage to undisclosed or unmarked utilities, irrigation systems, or subsurface conditions. The customer assumes full responsibility for any damage resulting from failure to disclose known site conditions.

6. Utility Locates

Legacy Paving & Construction, LLC complies with Oregon 811 and Washington 811 utility locate requirements. Public utility locates will be requested as required by law. However, private utilities — including but not limited to irrigation systems, private drainage lines, invisible dog fences, and privately installed conduit — are the responsibility of the customer to mark or disclose prior to the start of work. Legacy Paving is not liable for damage to private utilities that were not disclosed or marked.

7. Warranty

Legacy Paving & Construction, LLC stands behind our work. Any warranty terms will be specified in the individual project contract. General warranty exclusions include:

Damage caused by tree roots, ground movement, or subsurface conditions outside our control
Damage resulting from improper use, overloading, or failure to maintain the surface
Hairline cracking due to natural curing and settling of asphalt or concrete
Work performed on surfaces with pre-existing drainage or structural issues that were disclosed or visible at the time of estimate
Acts of nature including but not limited to flooding, freeze-thaw cycles, and extreme weather events

No warranty is implied beyond what is expressly stated in the signed project contract.

8. Liability Limitation

To the fullest extent permitted by Oregon and Washington law, Legacy Paving & Construction, LLC's total liability for any claim arising out of or related to our services shall not exceed the total amount paid by the customer for the specific work giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

9. Property Damage

Legacy Paving & Construction, LLC carries general liability insurance. Any claims for property damage allegedly caused by our work must be reported in writing within 7 days of project completion. Claims submitted after this period may not be honored. We are not responsible for minor, unavoidable damage incidental to construction activity, such as tire marks, dust, or temporary disruption to adjacent surfaces.

10. Scheduling & Weather

Construction work is subject to weather conditions. Legacy Paving reserves the right to reschedule any project due to rain, extreme temperatures, or other conditions that would compromise the quality of the work. We will make reasonable efforts to notify customers of schedule changes in advance. Rescheduling due to weather does not constitute a breach of contract.

11. Photography & Marketing

Legacy Paving & Construction, LLC may photograph or document completed work for use in marketing materials, social media, and our website. No personally identifying customer information will be used without consent. If you do not want your project photographed, notify us in writing prior to the start of work.

12. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith communication. If a resolution cannot be reached, disputes shall be resolved through binding arbitration or in the appropriate court of jurisdiction based on the project location — Yamhill County, Oregon for Oregon projects, and the applicable Washington county for Washington projects. These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Oregon, unless the project is located in Washington, in which case Washington state law applies.

Legacy Paving & Construction, LLC is a licensed contractor in:

We comply with all applicable Oregon and Washington contractor licensing laws, OSHA safety regulations, prevailing wage requirements where applicable, and environmental regulations.

14. Website Use

The content on legacypavingllc.com is provided for informational purposes only. Nothing on this website constitutes a binding offer, contract, or guarantee of availability or pricing. We reserve the right to update, modify, or remove website content at any time without notice.

Unauthorized use of our website content, logos, or materials without written permission is prohibited.

15. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of our website or services after any update constitutes acceptance of the revised terms.
